No charges filed against clerk in deadly Don's Guns shooting

The Marion County Prosecutor's Office will not file charges against a Don's Guns clerk who shot and killed a man who opened fire inside the store.

The Marion County Prosecutor's Office will not file charges against a Don's Guns clerk who shot and killed a man who opened fire inside the store.

Prosecutors reviewed the Sept. 17 shooting with an Indianapolis Metropolitan police detective and determined that charges were not warranted. According to prosecutors, accounts from witnesses and surveillance footage showed the clerk acted in self-defense.

Brian Wayner, 26, died following the shooting at Don's Guns and Galleries, Inc., 3807 Lafayette Rd.

Store owner Don Davis told Fox59 that Wayner came into the store, rented a gun and shot three boxes worth of ammunition. When he came to check out, Davis said Wayner shot the clerk twice. The clerk fired back, killing Wayner.
