Judge will decide on Neighbors’ suit in two weeks

A decision on whether Huntington Beach violated environmental laws when it prepared its Downtown Specific Plan update is expected within the next two weeks.

If Orange County Superior Court Judge Nancy Wieben Stock finds the city in violation of the environmental impact report, the city will have to either add addendums to the report or redraft it to reflect the impact of future development in downtown.

On Thursday, Wieben Stock heard the Huntington Beach Neighbors’ arguments on why the city’s report doesn’t reflect what the group says is the real impact the city’s downtown development plans will have.

The Neighbors filed the lawsuit last year claiming the city documented the traffic and noise impact during rainy and cold days instead of peak city traffic in the summer and on weekends.

City officials said the report is credible.
