Woman claims city needs to create even surfaces

An Anaheim woman filed a claim May 17 asking for $50,000 after she tripped over an uneven sidewalk in Huntington Beach.

Peggy Carroll, 66, alleged the city was negligent in maintaining a portion of sidewalk and wants $50,000 in damages in a claim.

Carroll was walking westbound on the sidewalk on Knoxville Avenue on Dec. 16 when she tripped and fell over an uneven portion of the sidewalk, according to the claim. The section was raised by the roots of a nearby tree.

“The city of Huntington Beach had a duty to create an even surface on the sidewalk. The city breached [its] duty because the sidewalk was uneven,” the claim states. “The breach caused Ms. Carroll’s injuries.”

The fall caused Carroll pain in her back, neck and shoulders, according to the claim.
